No more recognised victims in CIA black site investigation, for now

The Appellate Prosecutor’s Office in Cracow has refused to officially recognise Mustafa al-Hawsawi as a victim in the probe into the operations of a secret CIA facility in Poland. Mr al-Hawsawi is reported to have been detained and tortured on Polish soil. His attorney, advocate Bogumił Zygmont, said he would appeal against the prosecutor office’s decision.

Currently, three individuals are officially recognised as victims in the proceedings. They are Abu Zubaydah, Abd al-Rahim al-Nashiri and Walid bin Attash, all detained in the Guantanamo base. They claim to have been illegally imprisoned and tortured in Poland. The investigation into the operations of a secret CIA facility said to have been established in Poland as part of the so-called war on terror, was launched in 2008.

The cases of al-Nashiri and Abu Zubaydah vs. Poland are pending before the European Court of Human Rights. On 2 and 3 December 2013, the Court heard the joined cases.

In January 2014 The Washington Post wrote that in 2003 Poland reportedly received 15 million dollars from US authorities to host the secret prison in Stare Kiejkuty.

HRC56: Human rights in the temporarily occupied territories of Ukraine

On 10 July 2024, Human Rights House Foundation delivered a statement at the 56th session of the UN Human Rights Council, welcoming the release of Nariman Dzhelal, repeating calls for the release of Server Mustafayev, and raising concerns about the situation for forced transfers of Ukrainian civilians within the temporarily occupied territories of Ukraine and to the Russian Federation.
