Advocate Mikołaj Pietrzak of the Pietrzak & Sidor Law Office in Warsaw filed a motion to be admitted to the investigation conducted by the Appellate Prosecutor in Warsaw, as a representative of Abd al-Rahim al-Nashiri, who is one of the victims of the secret CIA prison in Poland. For 2 years, the Prosecutor has been investigating the possible abuse of power by Polish public officials in connection with the activity of the secret CIA site in Poland. This is the first case of a prisoner of the CIA site taking part in the proceedings.

Multiple sources, mainly publicly available (such as the 2007 Council of Europe Report prepared by Dick Marty, a 2010 UN Special Rapporteur’s Report, the CIA Inspector General Special Review dated 7th May 2004 and the Report of the International Committee of the Red Cross dated 14th February 2007) provide information on a CIA site in Stare Kiejkuty, Poland, al-Nashiri’s rendition to Poland and his torture in CIA custody.

Announcing his participation in the investigation as the representative of al-Nashiri, advocate Mikołaj Pietrzak demanded that the prosecutor investigate and prosecute persons responsible for al-Nashiri’s transfer, detention and torture in the territory of Poland. The Advocate also filled also motions to examine many witnesses, including Polish public officials and witnesses abroad.

Al-Nashiri is the first victim of the CIA’s counterterrorism rendition program to pursue his rights as a victim in Poland.

Legal action on behalf of al-Nashiri is being taken in cooperation with the Open Society Justice Initiative.
