Human Rights Center Viasna monitors the criminal cases that were instigated in after the violent dispersal of the protest action against the falsification of the result of the presidential election.

At present Viasna informs that 25 people are suspects in the criminal case on mass riot, but the Belarusian NGO warns the information may be incomplete. 23 of them are in custody. Among the suspects there are as many as 7 out of 10 candidates for the presidential election.

Among the suspects are the award-winning journalist Iryna Khalip wife of the candidate Andrei Sannikov (left), and Nathalia Radzina (left), editor of the web-page www.charter97.org.

1. Aliaksandr Arastovich – M.Statkevich’s electioneering agent (in custody)
2. Aliaksandr Atroshchankau – press-secretary of the electoral team of Andrei Sannikau (in custody)
3. Dzmitry Bandarenka – a coordinator of the civil campaign European Belarus (in custody)
4. Artyom Breus – a citizen of the Russian Federation, was released from jail on 29 December together with other Russian citizens, was detained in half an hour within the framework of the criminal case (is kept in custody) – charges were given to him on 5 January
5. Andrei Dzmitryieu – the head of the electoral headquarters of Uladzimir Niakliayeu (gave a written undertaking not to leave)
6. Aliaksandr Fiaduta – intellectual, political scientist, a coordinator of the electoral team of Uladzimir Niakliayeu (in custody)
7. Ivan Gaponov – a citizen of the Russian Federation, released from jail together with other Russian citizens on 29 December and re-detained the same day (is kept in custody). Charges were given to him on 5 January.
8. Iryna Khalip – journalist, wife of Andrei Sannikau (in custody)

Article 293, ‘mass riot’:
1. The organization of the mass riot which was accompanied with violence against people, demolition, arsons, defilement of property and armed resistance to representatives of the authority, – is punished by 5-15 years of imprisonment.

2. Participation in mass riot which manifested in the direct implementation of the actions that were mentioned in part 1 of the article, – is punished by 3-8 years of imprisonment.

Criminal case upon Article 339, part 3 of the Criminal Code, ‘hooliganism’

1. Dzmitry Dashkevich (below) – Chairperson of the Young Front
2. Eduard Lobau – activist of the Young Front

Both of them were detained on 18 December and are in the status of suspects.

Article 339, ‘hooliganism’:
1. Deliberate actions that grossly violate the public order and demonstrate an evident disrespect to the society, which are accompanied with the use of violence or the threat of its use or destruction or waste of property of other people, or are defined by an exceptional cynicism (hooliganism)

2. Hooliganism, committed repeatedly or by a group of persons or connected with resistance to a person that stops the hooligan actions, or accompanied with the infliction of a less hard bodily injuries (malignant hooliganism)

3. The actions that are provided by parts 1 and 2 of the article, committed with the use of weapons and other items that are used as a weapon for infliction of bodily injuries, with the use of explosives or explosive devices or are committed with the threat of their use, in the absence of the traits of a harder crime (especially malignant hooliganism) are punished with 3-10 years of imprisonment.
